Payments — Tebex as Merchant of Record
Sales of the digital products and content offered on the site are handled, as regards payment, by Tebex Limited ("Tebex"), which acts as Merchant of Record (the seller of record towards the consumer for the payment transaction).
This means that, at the time of payment, the financial transaction is concluded with Tebex, which acts as seller towards the user, collects the price and manages the related payment obligations. The purchase is also subject to Tebex's terms and policies, available on the provider's website. Alternative dispute resolution (ADR)
To resolve any disputes with consumers, in addition to judicial protection, it is possible to use alternative dispute resolution (ADR) procedures, such as conciliation and mediation. Such procedures may be activated, for example, before ADR bodies entered in the relevant registers or before the conciliation desks of the territorially competent Chambers of Commerce.
Recourse to such procedures is optional and does not affect the consumer's right to bring the matter before the competent judicial authority.
Applicable law and competent court
The relationship between Emerals S.R.L. and the user is governed by Italian law.
For disputes with consumers, the court of the place of residence or domicile of the consumer, if located within the territory of the State, has mandatory jurisdiction, pursuant to Article 66-bis of the Italian Consumer Code (Legislative Decree 206/2005).
